After you have prepared your Will, Will storage is essential.  Your Will should be kept in a safe place, known to your executors.

When you prepare a new Will, your will writer will want to see a copy of any Will you have previously written. I regularly experience difficulties with prospective clients on this issue. Wills have gone missing, or they are stored with a lawyer who, on investigation, is no longer practicing. If clients are unable to access their will, I am sure their executors will also have problems. In the worst case it may be considered lost and so ignored.

There is no requirement to register a Will in England and Wales. However, HM Courts & Tribunals Service (HMCTS) offers a service to help individuals in the storage of their Wills. Compared to similar commercial services which are paid for annually, HMCTS offers the service for a small one-off fee (£20 as at February 2022). Further, the service is not going to experience some of the problems associated with commercial undertakings.

For expats is there is no need to visit your local office of HMCTS to hand deliver the Will. They now accept delivery by courier or registered post subject to following their protocol. For full details of the service and the process you need to complete, please click this link.
