When you prepare a new Will, your will writer will want to see a copy of any Will you have previously written. I regularly experience difficulties with prospective clients on this issue. Wills have gone missing, or they are stored with a lawyer who, on investigation, is no longer practicing. If clients are unable to access their will, I am sure their executors will also have problems. In the worst case it may be considered lost and so ignored.

There is no requirement to register a Will in England and Wales. However, HM Courts & Tribunals Service (HMCTS) offers a service to help individuals in the storage of their Wills. Compared to similar commercial services which are paid for annually, HMCTS offers the service for a small one-off fee (£20 as at February 2022). Further, the service is not going to experience some of the problems associated with commercial undertakings.
